Agreement to Terms

By accessing or using PreBirdie's website and services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and that you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

Eligibility & Age Requirement

You must be at least 18 years of age to create an account or make a purchase on PreBirdie. By registering or placing an order you represent and warrant that you meet this age requirement. If you are under 18, you may not use our services.

Service Description

PreBirdie is a golf community platform that provides, among other things:

• Golf course reviews and community forums (Clubhouses)
• Featured small golf companies and custom club services
• Golf marketplace for merchandise and artisan custom club builds
• Tee time referrals through partner platforms

User Content

By posting content (reviews, forum posts, photos, etc.) on PreBirdie you grant us a non-exclusive, royalty-free, worldwide licence to display and distribute that content in connection with our services. You are solely responsible for ensuring your content does not infringe third-party rights or violate applicable law. We reserve the right to remove any content that violates these Terms.

User Responsibilities

As a user you agree to:

• Provide accurate information when creating an account or making purchases
• Keep your account credentials confidential and notify us of unauthorised access
• Follow community guidelines and treat other members with respect
• Submit accurate, good-faith course reviews and forum content
• Refrain from spam, harassment, or content that violates our community standards
• Comply with applicable laws when using affiliate partners or third-party services

Zero Tolerance for Objectionable Content & Abusive Users

PreBirdie has zero tolerance for objectionable content and abusive users. By using PreBirdie you agree not to post, upload, share, or otherwise transmit content that is obscene, hateful, violent, sexually explicit, defamatory, harassing, threatening, or otherwise objectionable, and you agree not to engage in abusive behaviour toward other members.

Prohibited content and conduct includes, without limitation:

• Hate speech, slurs, or content that targets people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any protected characteristic
• Harassment, bullying, threats, or stalking of any user
• Sexually explicit, pornographic, or graphic violent content
• Content that promotes self-harm, suicide, or dangerous activities
• Spam, scams, deceptive impersonation, or coordinated inauthentic behaviour
• Content that infringes intellectual property or violates applicable law

Reporting and blocking. Every post, comment, and user profile in PreBirdie includes mechanisms to (a) flag objectionable content for review and (b) block abusive users so they can no longer interact with you. Reports are reviewed by our moderation team within 24 hours, and we will remove violating content and suspend or permanently ban offending accounts.

Enforcement. We reserve the right, in our sole discretion, to remove any content and to suspend or terminate any account that violates these standards, with or without notice. Repeated or severe violations will result in a permanent ban. To report objectionable content or an abusive user, use the report controls in the app or email christian@prebirdie.com.

Limitation of Liability

PreBirdie acts as an intermediary between users and service providers. To the maximum extent permitted by law:

• We are not liable for acts, errors, or omissions of third-party providers (golf courses, affiliate partners, Stripe, etc.)
• User-generated content (reviews, forum posts) reflects the views of individual users, not PreBirdie
• We do not accept liability for personal injury or property damage arising from golf activities
• Our total aggregate liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses.

Force Majeure

PreBirdie shall not be liable for any failure to perform due to unforeseen circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, governmental actions, or pandemic-related restrictions.

Intellectual Property

All content on this website — including text, graphics, logos, and images — is the property of PreBirdie or its licensors and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.

Privacy and Data Protection

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Austin, Texas (or by video conference if agreed by both parties).

Class action waiver: You agree to resolve disputes only on an individual basis and not as part of any class or representative proceeding. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email to registered users and by posting an updated version here with a revised date. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
