Agreement to Terms

By accessing or using PreBirdie's website and services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and that you accept and agree to be bound by these Terms of Service and our Privacy Policy. Eligibility & Age Requirement

You must be at least 18 years of age to create an account or make a purchase on PreBirdie. By registering or placing an order you represent and warrant that you meet this age requirement. If you are under 18, you may not use our services.

Service Description

PreBirdie is a golf community platform that provides, among other things:

• Golf course reviews and community forums
• Featured small golf companies and custom club services
• Golf marketplace for merchandise and artisan custom club builds
• Golf trip planning inquiries and travel consulting
• Golf course reservations and tee time referrals

Booking and Payment Terms

Cancellation and Refund Policy

Cancellation policies vary by service and provider:

• Cancellations must be submitted in writing to christian@prebirdie.com
• Cancellation fees may apply depending on timing and the third-party provider's own policy
• Golf course and accommodation cancellation policies supersede our general policy
• Force majeure events may affect cancellation terms
• We strongly recommend purchasing comprehensive travel insurance

User Content

By posting content (reviews, forum posts, photos, etc.) on PreBirdie you grant us a non-exclusive, royalty-free, worldwide licence to display and distribute that content in connection with our services. You are solely responsible for ensuring your content does not infringe third-party rights or violate applicable law. We reserve the right to remove any content that violates these Terms.

Client Responsibilities

As a user you agree to:

• Provide accurate information when creating an account or making bookings
• Keep your account credentials confidential and notify us of unauthorised access
• Arrive on time for all scheduled activities
• Follow golf course rules, dress codes, and etiquette
• Respect property and other guests/members
• Carry appropriate identification and any required travel documents
• Inform us of relevant medical conditions or accessibility needs before travel

Limitation of Liability

PreBirdie acts as an intermediary between users and service providers. To the maximum extent permitted by law:

• We are not liable for acts, errors, or omissions of third-party providers (golf courses, hotels, Stripe, etc.)
• Weather conditions and course closures are beyond our control
• We do not accept liability for personal injury or property damage arising from golf activities
• Our total aggregate liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD $100
• We strongly recommend comprehensive travel and liability insurance

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses.

Force Majeure

PreBirdie shall not be liable for any failure to perform due to unforeseen circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, governmental actions, or pandemic-related restrictions.

Intellectual Property

All content on this website — including text, graphics, logos, and images — is the property of PreBirdie or its licensors and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Austin, Texas (or by video conference if agreed by both parties).

Class action waiver: You agree to resolve disputes only on an individual basis and not as part of any class or representative proceeding. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email to registered users and by posting an updated version here with a revised date. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
